Buyer Protection When Buying a New-Build Home in Spain

Buying a new-build home is one of the most important steps in many people's lives. However, it can also raise questions and uncertainties: What guarantees does the developer offer? What happens if there are delays in delivery? How is the money we hand over before receiving the keys protected?

🔒 1. Guarantee of Amounts Paid on Deposit
One of buyers' main fears is losing the money they have paid before the home is finished.
Law 38/1999 on Building Regulations (LOE) and Law 20/2015 establish that:

The developer is required to guarantee the amounts paid on deposit through a bank guarantee or surety bond.

The money must be deposited into a special account, designated exclusively for financing the construction.

If the work is not delivered on time or is not started, the buyer has the right to recover all the money advanced, plus interest.

🏗️ 2. Guarantees for construction defects
Once the home is received, the Building Regulations Act protects the buyer with different guarantees depending on the type of defect:

10 years: for structural damage (affecting the foundation, structure, etc.).

3 years: for defects in construction elements that affect habitability.

1 year: for defects in finishes or finishing.

During these periods, the developer and the building agents must respond to any defects detected.

📜 3. Contract and mandatory documentation
The developer is required to provide complete and accurate information before the sale:

Quality report.

Floor plans and description of the property.

Licenses, insurance, and guarantees.

Energy certificate.

Everything must match what is advertised. In the event of a discrepancy, the advertisement forms part of the contract, and the buyer can demand compliance or compensation.

🕒 4. Delays in Delivery
If the property is not delivered on the agreed date, the buyer has the right to:

Request termination of the contract and a refund of the amounts with interest.

Or agree to a reasonable extension if the delay is justified.

Some autonomous communities also allow claims for damages.

Verify that the developer is registered and has a good reputation.

Review the sales contract with a specialized lawyer.

Make sure all amounts you pay are guaranteed.

Keep all documentation and communications with the developer.
