Buyer Protection When Buying a New-Build Home in Spain Buying a new-build home is one of the most important steps in many people's lives. However, it can also raise questions and uncertainties: What guarantees does the developer offer? What happens if there are delays in delivery? How is the money we hand over before receiving the keys protected? Fortunately, in Spain, there are specific laws and protection mechanisms for new-build home buyers. 🔒 1. Guarantee of Amounts Paid on Deposit One of buyers' main fears is losing the money they have paid before the home is finished. Law 38/1999 on Building Regulations (LOE) and Law 20/2015 establish that: The developer is required to guarantee the amounts paid on deposit through a bank guarantee or surety bond. The money must be deposited into a special account, designated exclusively for financing the construction. If the work is not delivered on time or is not started, the buyer has the right to recover all the money advanced, plus interest. 👉 Tip: Before signing the contract, request a copy of the guarantee or insurance policy that covers your payments. 🏗️ 2. Guarantees for construction defects Once the home is received, the Building Regulations Act protects the buyer with different guarantees depending on the type of defect: 10 years: for structural damage (affecting the foundation, structure, etc.). 3 years: for defects in construction elements that affect habitability. 1 year: for defects in finishes or finishing. During these periods, the developer and the building agents must respond to any defects detected. 📜 3. Contract and mandatory documentation The developer is required to provide complete and accurate information before the sale: Quality report. Floor plans and description of the property. Licenses, insurance, and guarantees. Energy certificate. Everything must match what is advertised. In the event of a discrepancy, the advertisement forms part of the contract, and the buyer can demand compliance or compensation. 🕒 4. Delays in Delivery If the property is not delivered on the agreed date, the buyer has the right to: Request termination of the contract and a refund of the amounts with interest. Or agree to a reasonable extension if the delay is justified. Some autonomous communities also allow claims for damages. 🧾 5. Recommendations before signing Verify that the developer is registered and has a good reputation. Review the sales contract with a specialized lawyer. Make sure all amounts you pay are guaranteed. Keep all documentation and communications with the developer. 🧠 Conclusion Purchasing a new-build home in Spain is highly regulated and protected, but it's essential for buyers to be informed and claim their rights from the outset. With the right advice and proper documentation, buying off-plan can be a safe and satisfying experience.

Spain remains one of the favorite destinations for foreign buyers interested in the Spanish real estate market. They currently represent around 15% of residential sales, consolidating Spain as an attractive place to invest in housing. Who buys homes in Spain? The main foreign buyers come from France, Germany, the United Kingdom, the United States, and Nordic countries. This profile has evolved: they are no longer just looking for properties on the Mediterranean coast or in tourist areas, but also in cities with a high quality of life and good connectivity, such as Valencia, Malaga, and Seville. New trends: beyond the coast Real estate demand for foreigners is changing. Medium-sized, well-connected cities are gaining prominence compared to traditional coastal areas. This phenomenon opens up new opportunities for those seeking to buy homes abroad in Spain in areas with growth potential and quality of life. Impact of the Housing Law and current prices The recent Housing Law in Spain has introduced regulatory changes that, along with rising prices, require greater professional advice for foreign buyers. Transparency in the purchasing process and after-sales service are essential for investing safely. Tips for Buying a Home in Spain as a Foreigner Learn about local regulations and the Spanish Housing Law. Seek specialized advice to navigate procedures and bureaucracy. Explore options in emerging cities such as Valencia, Malaga, Alicante and Seville. Consider the transparency and quality of after-sales service when choosing a real estate agency. Investing in the Spanish real estate market for foreigners remains a solid opportunity in 2025, but requires strategy, knowledge, and professional support to maximize success.
